This memorandum in opposition is submitted on behalf of the New York State Association of Chiefs of Police, opposing the passage of Senate bill S 65 and Assembly bill A 1676.

Although the New York State Association of Chiefs of Police does not condone the inappropriate use of racial and ethnic profiling, the record keeping and policy development and distribution requirements contained in this measure constitute another unfunded mandate which local police departments will have to assume. This legislation would impose additional time consuming and burdensome duties upon already overburdened police departments working to reduce crime and promote public safety without adequate resources. New mandates such as those required under this proposal should include adequate funding to accomplish its goals.

Since this bill would require overburdened police agencies to perform significant additional duties without proper funding, we strongly oppose its enactment into law.
